അലഹബാദ്: ഉത്തർപ്രദേശിലെ സംഭാൽ ജില്ലയിൽ റമദാനിനിടെ പള്ളിയിൽ നമസ്കാരത്തിന് എത്തുന്നവരുടെ എണ്ണം നിയന്ത്രിച്ച ഭരണകൂടത്തിന്റെ നടപടി അലഹബാദ് ഹൈക്കോടതി തടഞ്ഞു. ക്രമസമാധാന പ്രശ്നം ഉണ്ടാകുമെന്ന കാരണത്താൽ ബദൗണിലെ സ്വകാര്യ സ്ഥലത്തുള്ള പള്ളിയിൽ നമസ്കാരത്തിന് നിയന്ത്രണം ഏർപ്പെടുത്തിയതിനെതിരെയാണ് കോടതി ഇടപെട്ടത്.

സ്വകാര്യ സ്ഥലങ്ങളിൽ മതപരമായ പ്രാർത്ഥനാ യോഗം നടത്തുന്നതിന് നിയമത്തിൽ വിലക്കില്ല എന്നും ക്രമസമാധാനം നിലനിർത്തുന്നത് സംസ്ഥാന സർക്കാരിന്റെ ഉത്തരവാദിത്തമാണെന്നും കോടതി നിരീക്ഷിച്ചു. “ഓരോ സമുദായത്തിനും അവരുടെ ആരാധനാലയത്തിൽ സമാധാനപരമായി ആരാധന നടത്താൻ കഴിയുമെന്ന് ഉറപ്പാക്കേണ്ടത് സംസ്ഥാനത്തിന്റെ കടമയാണ്,” കോടതി വ്യക്തമാക്കി.

ക്രമസമാധാനം പാലിക്കാൻ ജില്ലാ കലക്ടർക്കും പോലീസ് സൂപ്രണ്ടിനും കഴിയുന്നില്ലെങ്കിൽ അവർ രാജിവയ്ക്കുകയോ സംഭാലിന് പുറത്തേക്ക് സ്ഥലംമാറ്റം തേടുകയോ ചെയ്യണം എന്നും കോടതി വിമർശിച്ചു. പള്ളിയിൽ നമസ്കാരം നടത്തുന്നത് എങ്ങനെ ക്രമസമാധാന പ്രശ്നത്തിന് ഇടയാക്കുമെന്ന് കോടതി ചോദിച്ചു.

സ്വന്തം ഉടമസ്ഥതയിലുള്ള പള്ളിയിൽ 20ൽ കൂടുതൽ പേർ ഒത്തുകൂടി നമസ്കാരം നടത്തുന്നത് ജില്ലാഭരണകൂടം വിലക്കിയതിനെതിരെയാണ് ഹരജിക്കാരൻ കോടതിയെ സമീപിച്ചത്. ഇതിനെ തുടർന്ന് സ്വകാര്യ സ്ഥലത്തുള്ള പള്ളിയിൽ പ്രാർത്ഥന നടത്തുന്നതിൽ ഇടപെടരുതെന്ന് ജില്ലാ ഭരണകൂടത്തിനും പൊലീസിനും കോടതി നിർദേശം നൽകി.

ജസ്റ്റിസ് ശേഖർ ബി. സറഫും ജസ്റ്റിസ് വിവേക് സരണും അടങ്ങിയ ഡിവിഷൻ ബെഞ്ചാണ് ഉത്തരവ് പുറപ്പെടുവിച്ചത്.
